To: All Members of the Town of Victor Planning Board
Re: Application of Pioneer Corporation

Ladies and Gentlemen:

After considering the action of the Planning Board on April 25, 2000 I would like to request that the Planning Board put the Drumlins matter on the calendar for the next Planning Board Meeting to reconsider the action that it took last evening.

As was indicated the application of Pioneer Corp. is incomplete. The Planning Board however accepted the "incomplete" application for construction although such an application when incomplete, should not have been accepted. As a result of the matter being a pending matter on the Planning Board agenda the concerned citizens of the Drumlin area who oppose this project were required to retain counsel and expend a substantial amount of money to formulate the opposition.

If the application is merely considered "incomplete" all that the developer has to do is to get Victor to change its decision that no sewers were available and then the application can go forward. The citizens of the Drumlin area are therefore up in the air as to whether or not this application will be acted upon at a later date. Since it was "incomplete" it should never have been put on the calendar and therefore the citizens should not have been put to the trouble and expense that has been involved.

Either the developer knew that the sewer was not committed and misrepresented to the Planning Board or the developer did not know that the sewers were not committed, and in either event, the incomplete application had no place on the Planning Board calendar.

I understand that the Village of Victor has been sued because it has refused to grant sewer rights to the developer. This makes it even more imperative that your Board take definitive action to dismiss the application so that your Board cannot be accused of delaying action.

If the Planning Board wishes me to appear at the next Planning Board meeting I would be pleased to do so to discuss this matter. If I do not hear from the Chairman of the Planning Board or the Planning Board attorney I will assume that you do not request my appearance and I therefore renew the request of 233 persons who signed the Petition that the matter be denied and dismissed.

I also ask the Planning Board to consider the Petition and my presentation on Tuesday evening, April 25th with respect to recommending to the Town Board that it rezone the Drumlins area back to R-2.
