Negotiations, but no resolution in Drumlins suitNegotiations with a company that wants to build rental housing are expected to continue.By KRIS DREESSEN VICTOR - The Village Board has started negotiating with the developers of the Drumlins apartment complex, but no agreement has been reached. Karl Essler, an attorney for The Pioneer Corp. and John G. Turner, discussed a possible settlement with Village Board members and the village attorney last night in executive session for nearly an hour. "But no agreements have been made at this time," said village attorney William Kocher. Kocher said negotiations will continue to see if a resolution can be made before the lawsuit goes to court on Sept. 12. Pioneer and Turner are asking a state Supreme Court judge to rule on the lawsuit it filed against the village to gain access to Victor's sewer system. With the motion for summary judgment, Pioneer and Turner are asking the judge to hear arguments in the case and make a ruling, instead of having the case go to trial. Pioneer is the project developer. Turner is president of Ontario Heights Development and owns the land. Pioneer is suing the village because it wants to build 154 upscale apartments in the existing Drumlins subdivision off of Rawson Road in Victor. The village says it is unable to take on the additional waste water from the complex, and that it is operating under a consent order by the state Department of Environmental Conservation. The village this until fall to upgrade the system. The town Planning Board deemed Pioneer's project application incomplete because the village said it cannot provide sewer service to the complex. The project has been in limbo for months. If the lawsuit is heard in court on Sept. 12 and the village loses, the village could appeal the judge's decision in the Appellate division, according to Kocher. If the village were to win an appeal, the case would be referred to trial, he said.
