DCC Update - Rental UnitsDecember 20, 2000 At
the December 19 Planning Board Meeting, Pioneer’s attorney, Jerry Goldman,
presented an aerial map and discussed “distances” from their rental
townhouses to homes on Wellington and in The Drumlins; no mention was made of
the close proximity to Burlington and Silver Hill Path. He showed an artist’s
rendering of the proposed clubhouse — it was the same as had been presented a
year ago — and also two renderings of the actual 7- or 8-unit buildings. One
rendering he showed to residents in attendance was actually the side view (81’).
We were not shown the front view — the board saw it — which is considerably
larger (140’). It
was not appropriate for the DCC to raise specific points at this meeting;
however, we certainly do not want the community to feel we have no grounds on
which to object to this project. We have LOTS of basis to oppose any
granting of a permit for construction. If the town authorities do not take the
residents’ interests as a primary concern, reluctantly as we are to do so, we
have every intention to raise these issues in the State Supreme Court with a
lawsuit — called an Article 78 — against the Town of Victor. Rental units in
the proposed density are not compatible with the existing character of the
neighborhood, and are a serious deviation from the approval for rezoning. Our
time to speak will be at the Public Hearing, and speak we will! It may be
scheduled for Tuesday, February 13. The Formal Presentation is scheduled for
Tuesday, January 9. At that time Pioneer should present their entire information
to the board and the residents. Citizens may be permitted to ask the developers
questions at that time. Our
formal opposition will begin at the Public Hearing. It may be frustrating to
hear board members’ comments complimenting the developers and the project, but
the important and outstanding issues are yet to be addressed. This is the time
to listen. It’s been rather obvious for sometime that the boards look
favorably upon these developers, so passage of their proposal will not be any
surprise. However, then we can confidently file our lawsuit, unless the town
gives good, deep thought to the citizens’ interests. Thank you for

Hill Path and Wellington Road has been indicative of how seriously we expect the
town officials to consider the following items when making a final

Character
of the neighborhood ·
The
environmentally sensitive lands (did you know Pioneer’s Environmental
Assessment Form [Dec. 6, 2000] states they will remove 21.9 acres of vegetation
[trees, shrubs, ground cover] from 26.8 acres of the land?) ·
Density ·
Home
ownership ·
Size
of the proposed structures (140’ x 81’ x 34’) There
certainly is NO reason to feel, “This is over.” In fact, if
necessary, this is just the beginning of our formal opposition. Your continued
